The Overstrand Municipality (OM), under the Municipal Land Use Planning By-law and the Scheme Regulations, updated and introduced overlay zones which put in place special planning provisions for specified areas. Throughout the OM there are a number of Heritage Overlay Protection Zones (“HPOZ”), Buffer Area Heritage Protection overlay zones and Environmental Management Overlay Zones (“EMOZ”). OM designated those parts of Rooiels that can be seen from Clarence Drive as the Rooiels Heritage Protection Overlay Zone (you can download the REHPOZ as per the 2020 Provincial Gazette below). The purpose of these Overlay Zones is to protect the particular aesthetics, natural or historical value of particular places within the Overstrand by providing for specific planning regulations related to their conservation.
At the Ward 10 June, 2022 meeting in Betty's Bay, a Hangklip Villages Conservation Overlay Zone (HCOZ) was proposed to limit the light footprint from homes in Betty's Bay, Pringle Bay and Rooiels. This is to help maintain our dark night skies and allow residents and visitors a chance to "star-gaze". At a meeting of the Rooiels community held in November 2019 (Information Cascade) the community agreed to request OM to apply adapted provisions of the REHPOZ to all of Rooiels and to afford the entire village protection as a heritage area in its entirety, as well as to provide for additional protections as afforded to some other communities in the Overberg. Senior Manager, Mr. Kuchar, from the Overstrand Municipality agreed that the OM would extend protection to the entire village and suggested that meetings to discuss this be held in 2020. Working groups had earlier been established to address environmental as well as urban development issues. The HPOZ urban development group included Eldie Brink, Geoff Harris; Piet van Rensburg; Mark Butler, and David van der Merwe with some inputs from Kay Leresche.
The draft RECOZ (Rooiels Conservation Overlay Zone) which applies to the whole village (as presented and accepted at the Information Cascade) was then further refined by the working group and adapted to adhere to the changed scheme regulations and EMOZ provisions for presentation to the Overstrand Municipality.
At an open meeting in June 2021 it was stated that RECOZ would be submitted to the Overstrand Municipality. In September 2021 the RECOZ was circulated and posted on this website (1 February, 2021 version) available to the residents of Rooiels for any further comments before finalization and submission to OM.
