Erf 317 has applied for a departure to relax the Street Building line to accommodate the garage. Attached below are the documents providing details. This is an application for a departure to allow the garage to be better positioned. Both neighbours have approved the departure. It has now been circulated to RERA with a request to make it available to all residents. Anyone that would like to make individual comments should send them to directly to Loretta Gillion ([email protected]) before 24th June. 2022. From a very quick preliminary perusal of this comprehensive application, RERA Exco note that the title deed, Scheme Regulations, and RECOZ, all provide for approval of departures for this type of garage problem with appropriate motivation. The applicant has apparently taken great care to motivate compliance. We are looking into the height restriction and assessing the application in more depth before responding. Please alert us to any particular aspect the Exco should consider when responding on behalf of RERA.

RERA NOTES FROM WARDS 9 AND 10 MEETING WITH MAYOR 26 APRIL 2022
1. Attended by Anuta Scholtz and Eldie Brink BUDGET 2.1 RERA’s request that the budget scheduling of stormwater and other listed strategic expenses be made available for comment, was accepted by the mayor for all wards. 2.2 Our ward councilor is expressly requested by mayor to send the information to RERA. 2.3 Budget will be finalised with Chief Financial Officer on deadline 9 May, when comments will be dealt with 2.4 Mayor says she is not sure that community requirements of the wards have been taken into account, therefor 9 May date is very important. 2.5 The mayor states that RE is entitled to the information and that the information should be given to RE. 2. INTEGRATED DEVELOPMENT PLAN (IDP) 2.1 Process for future new IDP commences August 2022 with public participation 2.2 The RERA written comment is explained that the reference to the Spatial Development Plan in the present Overstrand Draft IDP Amendment 2022/23l be amended as follows: In CHAPTER 10: SPATIAL DEVELOPMENT FRAMEWORK: Please DELETE where it reads as follows –: “A New Urban Development area is proposed on the southern periphery of the settlement. The land area is ± 1.12ha in extent and was included by realignment of the urban edge with the coastal management line.” And REPLACE WITH “No new urban development is proposed for Rooiels and the development of the existing vacant erven are prioritised.” 2.3 The mayor personally requests from us and receives the RERA written submission with the RERA email address on it. 3 SPATIAL DEVELOPMENT PLAN (SDP) 3.1 Mr. S Muller Director: Infrastructure and Planning points out that the SDP guides where future development could take place. (Note: That is why the RERA comment in par2.2 is so important) 3.2 Mr. Muller states that all the urban edges are limited to the existing boundaries, except for the Mooiuitsig area in par 3.3 below. 3.3 The proposed BB infill for low cost housing, (also in Chapter 10 of the present draft) adjoining Mooiuitsig was hotly opposed on WhatsUp, but none of the participants attended the meeting. An attendee refers to apparently related previous comments to the mayor, who will look into the matter. No other concerns raised. Attendees are soothed with assurances that proper legal process will follow (Note: RERA in its submission emphasised its concern that such proposals when included in the present document could, in future decision making, be regarded as support). 4. PRAISE FOR WARDS 9 AND 10 Mayor notes that these two wards are probably the most active wards in the OM. 5. BUFFELS RIVER LAND AND WORKS 5.1 Eldie draws the attention of the meeting to the history of the Buffels River Dam. 5.2 It is the property of RE, PB and the final extension to BB in 1945. It is not the property of the greater BB. (We should have added that historically BB should receive water per an annually renewed contract, approved by RE and PB, as was the case since 1945) 5.3 We pointed out that circumstances may arise when a differentiation with BB may need to be made. (Note: Where will the water for the Mooiuitsig low cost development come from if BB is not per se entitled to water from the Buffels River Dam?) 0O0 Some notes on aspects raised.:
